INLEAD – Terms of Use (August 2021)

These ‘Terms of Use’ (the “Terms“) contain the terms and conditions according to which REVEAL LLC (Reitergasse 11, 8004 Zurich), doing business as INLEAD (“INLEAD“) may grant you (“You” or “User“) access to its e-learning platform (the “Services“).

1. Acceptance and Valid Contract

You accept these Terms by accessing the Services. If you do not accept these Terms then you may not use the Services. INLEAD may change or adapt these Terms at any time and will communicate such changes to you in an appropriate manner. You accept the changes when you access the Services after having been made aware of them.

By accepting these Terms, you enter into a valid contract with INLEAD regarding access to the Services at the terms and conditions set out herein.

2. Services

Based on a license contract between your employer (or principal) and INLEAD (or between You and INLEAD, as the case may be), INLEAD will grant You access to certain modules of its e‑learning platform in their current version, subject to these Terms. Your right to access and use these modules is conditioned on your compliance with these Terms and compliance with the license contract. In case of non-compliance, INLEAD may suspend or terminate Your access at any time.

The Services are provided ‘as is’ and ‘as available’ without any warranty or support. INLEAD does not make any representations and disclaim all warranties, express, implied or statutory, including regarding fitness for a particular purpose or use, satisfactory quality and non-infringement. INLEAD may at any time change, alter or amend the Services, which may lead to the Services temporarily not being available. INLEAD does not guarantee a specific level of availability.

3. Your Obligations

You are, at your own cost, responsible for the means necessary to access the Services, including all required hardware, system and internet software on your side (such as e.g. a current browser in a version as supported by the Services) as well as for the internet connection required to access the Services.

You are required to provide correct information and data regarding yourself in order for us to grant you access to the Services, and to update such information in case of any changes. Information regarding the treatment of personal data can be found in our Privacy Policy.

You must take all required measures to prevent unauthorized access to the Services. In particular, you must not share any login credentials, passwords or similar with anybody. If you become aware of any unauthorized use of your access means or credentials, or any other unauthorized access attempt or attack on the security of the Services, you must inform INLEAD immediately.

4. Compliant Use

You may use the Services only as allowed by law and according to these Terms. You may not use the Services or any content thereof for any other purpose than intended.

In particular, you may not (a) access all or any part of the Services in order to create or build a product or service which competes in whole or in part with the Services; (b) reverse engineer, decompile, disassemble, modify, license, sell, rent, lease, transfer, assign, distribute, display, disclose, or otherwise commercially exploit the Services or any part thereof, or otherwise make the Services or their content available to any third party; or (c) interfere with or disrupt the integrity or performance of the Services or attempt to gain unauthorized access to the Services or their related systems or networks.

If INLEAD suspects any non-compliant use, INLEAD may at any time suspend Your access to the Services immediately.

5. Liability

Any and all liability of INLEAD for all damages caused by INLEAD, its employees, directors, officers, contractors and auxiliaries, is hereby excluded to the fullest extent permitted by law, except in case of intent, gross negligence, personal injury and mandatory statutory liability. This exclusion of liability is applicable to all types and categories of damages, including indirect and consequential damages (including loss of data), regardless of its legal basis.

6. Intellectual Property Rights

Under these Terms, no intellectual property rights shall be transferred to You. INLEAD and/or its licensors shall own all intellectual property rights in the Services, their content, and all related software and applications.

7. Applicable Law and Jurisdiction

If any provision of these Terms is held unenforceable, the remainder of these Terms shall remain in full force and effect. These Terms are governed by Swiss law. Exclusive place of jurisdiction is Zurich 1, Switzerland.
